A fatal rollover on Highway 101 near Petaluma has led to the driver facing felony DUI and murder charges, according to the California Highway Patrol (CHP) Santa Rosa area office.

CHP reports that the solo-vehicle crash involved a BMW that left the roadway and rolled over, ejecting two passengers. The driver remained inside the vehicle and sustained major injuries.

The February 11 incident claimed the life of 61-year-old Teresa Renderos of Novato. A second passenger was taken to the hospital in serious condition.

A preliminary investigation indicates the driver lost control while traveling southbound for reasons that remain under review. Speed and wet roadway conditions were identified as likely contributing factors.

CHP has stated that the driver was allegedly under the influence of alcohol at the time of the rollover and had a prior DUI-related crash and arrest in 2022. The Sonoma County District Attorney’s office will decide whether criminal charges are pursued. When a fatal crash involves impaired driving, questions about civil liability may also arise.

Civil Accountability After a Fatal DUI Crash

Criminal cases decide whether someone committed a crime and what punishment may apply. Civil cases are separate and deal with financial responsibility for the harm caused.

Because this incident involved both a fatality and an injured survivor, different types of civil claims may arise. When a life is lost in circumstances like these, certain surviving family members of the deceased may have the right to pursue a wrongful death claim. Individuals who survive the same incident with injuries may pursue a personal injury claim for losses such as medical expenses, lost income, and other impacts of their injuries. These claims may involve different categories of damages, including general, special, and in some circumstances punitive damages.

In California, wrongful death laws allow compensation for funeral expenses, lost financial support, and the loss of care, companionship, and household services. Whether a claim is available depends on the specific circumstances, the relationships involved, and applicable insurance coverage.
